SectorCare Terms & Conditions: Website Use & Purchases
When you create an account, make a purchase, or otherwise engage with www.sectorcare.com.au, you agree that you are bound by the current terms and conditions set by Safety Sector Pty Ltd, trading as SectorCare.
1. Placing Order / Pricing
Any quotation provided by SectorCare is not an offer to sell, and no order given based on any quotation is binding unless accepted by SectorCare in writing. Unless otherwise agreed, all orders are subject to acceptance by SectorCare within seven (7) days of receipt.
All pricing is in Australian Dollars and inclusive of GST. Pricing and stock availability are subject to change without notice. SectorCare reserves the right not to sell any product below cost. All orders placed are subject to confirmation and acceptance.
SectorCare may vary prices in the event of supplier changes, increased shipping costs, or errors. If SectorCare requests payment for price increases, you may cancel the order by notifying us within seven (7) days of receiving the notice.
To minimise errors and improve efficiency, customers should place orders through our online ordering system wherever possible.
SectorCare reserves the right to adjust and revise freight charges at any time before the order is confirmed.
2. Delivery / Collection
We do not ship to PO Box addresses.
We do not ship to third-party addresses unless the address is known and verified by SectorCare.
The customer shall, at their own expense, arrange collection of products from SectorCare’s premises unless delivery has been quoted and agreed. Alternatively, at SectorCare’s discretion, physical delivery may be arranged to the customer’s address, with all freight costs payable by the customer.
Customers assume all risk and liability for loss or damage to products once they have been collected or dispatched, unless the customer has purchased insurance.
Customers are responsible for ensuring someone is available at the delivery address to sign for and accept delivery. Costs for re-delivery attempts will be charged to the customer if the delivery address is unattended.
3. Delivery Time
Any estimated delivery time provided is an estimate only. Unless a written guarantee is provided by SectorCare for liquidated damages due to late delivery, SectorCare shall not be liable for any loss or damage arising from late delivery on or before the quoted date.
The customer must accept and pay for products regardless of delays, including courier delays outside SectorCare’s control.
Goods specially ordered must be fully paid prior to delivery and cannot be returned or exchanged without prior written approval.
4. Return / Refund / Cancellation
No credit will be issued for price differences due to later price drops. Customers should select carefully before ordering. Refunds for change of mind are not accepted unless agreed by SectorCare and only if the item is unused and in original packaging.
Any incorrect, missing, or damaged items must be reported to SectorCare within seven (7) days of delivery via email or phone.
SectorCare owns the title of any extra goods shipped by mistake.
If requested, customers may be required to provide information to assist with processing refunds or cancellations. Failure to provide accurate information may delay resolution.
Cancellation requests must be made as soon as possible. If the order has been dispatched, the customer will be charged all shipping and handling fees related to returning the item.
Cancellations for special-order items will incur a 25% cancellation fee. Freight charges are non-refundable.
Custom products and printing services are non-refundable.
5. Payment
Unless agreed otherwise, payment for all products must be made in full by the customer to SectorCare within seven (7) days of the order date, or upon checkout for online orders.
Online payments may be made via credit card, PayPal, or other accepted payment methods. Phone or email orders may be paid via credit card, direct deposit, or approved company cheque.
6. Liability
a) SectorCare shall not be liable for any loss or damage whatsoever arising directly or indirectly in connection with the products, other than liability required under Australian Consumer Law.
b) SectorCare expressly excludes liability for consequential loss including, but not limited to, loss of profits, business, revenue, goodwill, anticipated savings, or data.
7. Retention of Title
Title to the products passes to the customer only after full payment has been received.
Until full payment is made:
-
The customer holds the products as bailee for SectorCare.
-
Products must be stored safely, at the customer’s risk, and clearly identified as SectorCare property.
-
The customer indemnifies SectorCare against any claim, action, or loss related to the use or disposal of products before title passes.
-
SectorCare may inspect or recover goods at any reasonable time if payment is not made.
-
Proceeds of any sale must be kept in a separate account and held on trust for SectorCare
8. Customer Obligations
Customers must provide accurate and complete information at all times. The customer is responsible for maintaining confidentiality of their account.
SectorCare may request additional identification to prevent fraud and ensure account security.
SectorCare reserves the right to terminate any customer account containing false, incomplete, or inaccurate information.
SectorCare does not store credit card details. Customers must ensure their own credit card security.
